Welcome to County National Bank’s suite of digital banking services! This agreement outlines the terms and conditions governing your use of our online banking, mobile banking, and bill pay services. To enroll and enjoy the convenience of managing your finances digitally, you’ll need to agree to the terms detailed in this County National Bank Electronic Banking Agreement.
Enrollment and Access
To begin, ensure you have your PIN (Telebanc PIN) ready. If you’re unsure of your PIN, please contact our customer service team at 1-888-322-1088 or 517-439-4300 during our normal business hours. You will then be prompted to create a unique Username, password, and security questions to secure your access to County National Bank’s online and mobile platforms.
Important First Step: For security reasons, you must log in to online banking at least once before activating mobile banking or bill pay features.
By clicking “I Agree” at the end of this document, you acknowledge and consent to the terms and conditions of the County National Bank Electronic Banking Agreement, granting you access to our online banking, mobile banking, and bill pay services. Your continued use of these services signifies your ongoing agreement to this document.

COUNTY NATIONAL BANK ELECTRONIC BANKING AGREEMENT
This Electronic Banking Agreement (“Agreement”) defines the terms and conditions for your use of County National Bank’s Online Banking, Mobile Banking, and Bill Pay services. These terms are supplementary to any existing agreements related to your accounts or other services with us. We recommend printing this agreement for your records or contacting us for a copy. The most current version is always accessible through Online Banking.
Acceptance of Terms
Before accessing Online Banking, Mobile Banking, Bill Pay, or any electronic services, you must: (a) consent to electronic delivery of disclosures, and (b) accept the terms and conditions of this Agreement by clicking “I Agree.” Furthermore, each login to Online or Mobile Banking and each use of Online Banking, Mobile Banking, or Bill Pay constitutes a renewal of your acceptance of this Agreement.
Each Authorized User will have individual login credentials (Username and password) allowing them to access and transact within Online Banking, Mobile Banking, and Bill Pay without needing further consent from other authorized users. Unless explicitly stated otherwise in this Agreement, you agree that County National Bank is authorized to act on instructions received via Online Banking, Mobile Banking, or Bill Pay under any Authorized User’s credentials. Account owners retain the right to terminate Online Banking, Mobile Banking, and Bill Pay services for their respective accounts.
I. Definitions
- “We,” “us,” “our,” “Bank,” and “County National Bank” refer to County National Bank.
- “You” and “your” refer to the County National Bank customer entering into this Agreement.
- “Account” or “Accounts” means your accounts enrolled for Online Banking, Mobile Banking, or Bill Pay. Eligible accounts include open and active County National Bank checking, savings, certificate of deposit, or line of credit accounts for Online and Mobile Banking. For Bill Pay, accounts must be open and active County National Bank checking accounts.
- “Authorized User” means each account owner and any individual authorized to sign on an Account.
- “Bill Pay” refers to the service allowing you to make payments to third-party payees from a designated checking Account through Online Banking or Mobile Banking.
- “Business Day” is defined as Monday through Friday, excluding federal holidays.
- “Electronic Funds Transfer” means transfers initiated through Mobile Banking or Online Banking to debit or credit a deposit Account primarily for personal, family, or household use, excluding wire transfers, inter-account transfers, or transfers between your accounts and family member accounts within County National Bank.
- “Mobile Banking” is the service enabling banking transactions and mobile alerts via a Mobile Device.
- “Mobile Device” includes cellular phones or similar wireless devices with Mobile Banking Software installed or capable of Mobile Banking transactions via permitted protocols.
- “Mobile Banking Software” is the software downloaded for Mobile Banking use, subject to change by County National Bank without notice.
- “Online Banking” is the service enabling banking transactions via a personal computer.
II. Online Banking Terms and Conditions
A. Access to Online Banking
To use County National Bank Online Banking, an Authorized User needs a personal computer with internet access. You are responsible for the setup, maintenance, and security of your software and computer systems. County National Bank is not liable for errors or failures related to telephone, internet, software, or computer issues.
Online Banking may occasionally be unavailable due to maintenance or unforeseen circumstances. While we will attempt to post notifications of extended downtimes on our website, County National Bank does not guarantee uninterrupted access on all computers, networks, or at all times. We are not liable for any damages resulting from the inability to access Online Banking, specific functions, transaction execution, or information retrieval.
B. Password and Username Security
Access to Online Banking requires an Authorized User to use their unique Username and password. Upon initial login, each Authorized User must create a new, secure Username and password. Passwords must meet complexity requirements:
- Minimum 9, maximum 17 characters
- Cannot contain keywords, predictable terms, username variations, or number series (e.g., Fiserv, CNB, Default, 12345)
- Must include uppercase and lowercase letters, numbers, and special characters
- Usernames and passwords are case-sensitive
Avoid using easily guessable information like social security numbers, addresses, birthdates, or family names for Usernames or passwords. Memorize passwords and avoid writing them down.
After three incorrect login attempts, Online Banking access will be suspended. To reset a password or obtain a temporary password, contact customer service at [email protected] or call the Electronic Banking Department at 517-439-4300 or 888-322-1088.
You are responsible for maintaining the confidentiality of your Username and password and ensuring that Authorized Users do the same. County National Bank is authorized to act on instructions received under any Authorized User’s credentials. Regularly change passwords to maintain security, ensuring all future passwords meet the stated requirements.
C. Types of Online Transactions
Through County National Bank Online Banking, an Authorized User can:
- Transfer funds between Accounts (excluding transfers to or from certificates of deposit).
- Review account balances, transaction history, and tax information.
- Download account data to financial management software (e.g., Quicken®, Microsoft® Money, QuickBooks®, Microsoft Excel®).
- Initiate payments via Bill Pay.
- Request stop payments on checks and ACH transactions from checking or savings accounts.
All transactions, especially those involving deposit accounts and stop payment requests, are subject to the terms of applicable deposit account agreements and disclosures. Line of credit account transactions are governed by loan agreements and previously provided disclosures.
D. Posting of Transfers
Transfers (excluding Bill Pay) initiated through Online Banking before 7:00 p.m. ET on a Business Day are posted the same day. Transfers made after 7:00 p.m. ET on a Business Day or on non-Business Days will be posted on the next Business Day. Authorized Users should coordinate to prevent overdrafts or exceeding credit limits when making transfers between accounts. Refer to Section IV.C for Bill Pay transfer processing details.
E. Transaction Limits
Transfers from savings or money market accounts to other accounts or third parties via preauthorized, automatic, or telephone transfers are limited to six per month or statement cycle. Transfers to or from certificates of deposit are not permitted through Online Banking. Bill Pay transactions can only be initiated from checking accounts.
F. Stop Payments via Online Banking
Authorized Users can request stop payments for checks and ACH transactions from checking or savings accounts via Online Banking. This service does not apply to Bill Pay transfers (see Section IV.D for Bill Pay cancellations). Online stop payment requests received by 7:00 p.m. ET on a Business Day are processed the same day. Requests after 7:00 p.m. ET or on non-Business Days are processed on the next Business Day. Online stop payment requests are binding upon receipt and do not require a signature.
To stop recurring Electronic Funds Transfers from a deposit account set up through Online Banking, call us at 1-888-322-1088 or write to County National Bank, One South Howell Street, P.O. Box 283, Hillsdale, Michigan 49242. Stop payment requests must be received at least three (3) Business Days before the scheduled transfer. County National Bank is liable for losses if a timely stop payment request is not honored.
G. Online Banking Fees
Currently, County National Bank does not charge direct fees for Online Banking. However, standard account fees, as outlined in agreements, disclosures, or fee schedules (e.g., overdraft fees), may still apply, even if incurred through Online Banking use. Bill Pay fees are detailed in Section IV.E. County National Bank reserves the right to introduce or modify Online Banking fees with prior notice, as per this Agreement and applicable law. You authorize County National Bank to deduct any applicable fees from your deposit Accounts. You are responsible for all internet service fees associated with Online Banking access.
III. Mobile Banking Terms and Conditions
Thank you for using County National Bank Mobile Banking! Standard message and data rates from your mobile carrier may apply. For assistance, text “HELP” to 99588. To cancel service, text “STOP” to 99588 at any time. For questions, please contact customer service at 888-322-1088 or visit https://www.cnbb.bank/.

Terms and Conditions Summary
- Program: County National Bank Mobile Banking provides account access via SMS for balance checks, transaction history, and account alerts. Enrollment requires user identification and mobile phone number verification via SMS. Users can customize alerts and preferences. This is an ongoing program; message & data rates apply. Opt-out available anytime.
- Questions: Contact us at 888-322-1088 or text “HELP” to 99588 for program inquiries.
- To Stop: Opt-out via SMS by texting “STOP” to 99588. Confirmation text will be sent, and no further messages will be delivered.
- Terms & Conditions: Participation in Mobile Banking implies agreement to these terms.
- Participating Carriers: Includes but not limited to AT&T, SprintPCS, T-Mobile®, U.S. Cellular®, Verizon Wireless, MetroPCS.
Mobile Banking and associated software may experience downtime beyond County National Bank’s control.
Privacy and User Information
By using Mobile Banking, you acknowledge that County National Bank and its service providers, including Fiserv, Inc., may collect User Information, including names, addresses, passwords, device numbers, transaction data, usage patterns (session length, transaction frequency, geolocation), and message content. County National Bank will protect User Information with reasonable safeguards but reserves the right to use and disclose this information as necessary to deliver Mobile Banking services, improve service analytics, comply with legal obligations, protect personal safety, defend claims, and as authorized by you. Monitoring of Mobile Banking usage for compliance is reserved, but County National Bank disclaims any obligation to actively monitor, filter, or edit content.
Restrictions on Mobile Banking Use
You agree not to use Mobile Banking or related software for any illegal, fraudulent, unauthorized, or improper purposes, adhering to all applicable laws, rules, and regulations. Prohibited uses include but are not limited to transmitting or disseminating:
- Unsolicited material, spam.
- Material infringing on intellectual property, privacy, or confidentiality rights.
- Illegal, harassing, defamatory, abusive, obscene, or otherwise objectionable content.
- Alcohol, tobacco, firearms, drugs, pornography, crime, violence, hate, or gambling-related content.
- Viruses, malware, or harmful code.
- False, misleading, or inaccurate information.
- Material that could expose County National Bank or its service providers to liability.
- Signals that could harm equipment or facilities.
You agree not to attempt unauthorized access to software or services, use third-party accounts, interfere with Mobile Banking provision or security, or abuse Mobile Banking services.
Use of Google Maps
Mobile Banking’s location features are powered by Google Maps. You agree to comply with Google’s Terms of Use and Legal Notices available at http://maps.google.com/help/terms_maps.html and http://www.maps.google.com/help/legal_notices_maps.html, or updated URLs provided by Google.
Fingerprint Login for Mobile Banking
County National Bank Mobile Banking offers optional fingerprint login on compatible Apple® (Touch ID™) and Android® devices. Fingerprint login requires fingerprint setup on your device (contact device manufacturer for assistance). Fingerprint data is stored only on your device; County National Bank does not access or store this information. Enabling fingerprint login allows anyone with a stored fingerprint on your device to access your Mobile Banking account. County National Bank reserves the right to disable this feature. Fingerprint login is linked to one Mobile Banking username per device. Standard login credentials (password) can be used if fingerprint recognition fails. Fingerprint login must be set up separately for each device. It can be enabled or disabled within Mobile Banking settings.

Card Controls Additional Terms (CNB CardHub)
CNB CardHub, powered by Fiserv, provides control over your County National Bank debit cards via a mobile app for easy financial management on the go.
App Features:
- Real-time account balances
- Money management tools
- Transaction and statement viewing
- Funds transfers
- Bill payments and biller management
- Check deposit
- Alert notifications
- Card management
This Privacy Policy, along with other relevant privacy notices, details the collection, use, and disclosure of personal information collected via the CNB CardHub app and website (“Services”).
Information Collection in the App
We collect personal information through your use of the Services in the following ways:
A. Personal Information You Provide Directly
- Account Creation: We collect personal details like name, address, email, phone number, and social security number during account setup.
- Transaction Information: Financial and transaction details necessary for Services, including account numbers, card details, transaction history.
- Feedback and Support: If you provide feedback or contact us via email, we collect your name, email, and email content for reply purposes.
- Voluntary Information: We collect other personal information provided voluntarily for support or other interactions.
B. Personal Information Collected from Third Parties
- Verification Services: We may collect information from identity verification services and credit bureaus to provide certain services.
C. Personal Information Collected Via Technology
We and our service providers automatically log data about your device, online activity, and interactions with our Services:
- Device Data: Operating system, device model, browser type, screen resolution, IP address, unique identifiers, location data.
- Online Activity Data: Pages viewed, time spent on pages, navigation paths, access times.
- Cookies: Text files stored on your device to identify your browser, remember preferences, and understand user activity.
- Local Storage Technologies: HTML5 and Flash for larger data storage, providing cookie-equivalent functionality.
- Web Beacons: Pixel tags or clear GIFs to track webpage or email access and content views.
- Location Information: With your consent, we collect location data when Services are used, even in the background, for fraud detection. Location tracking can be disabled in device settings.
How We Use Your Information Collected in the App
A. General Use
We use collected personal information to respond to requests, provide Services, and improve user experience:
- Account creation, security, and maintenance.
- User identification within our system.
- Improved Service administration.
- Service delivery as requested.
- Enhanced user experience.
- Administrative email notifications (security, support).
- Surveys, offers, and promotional materials.
B. Compliance and Protection
We may use your personal information for:
- Legal compliance and response to legal processes.
- Protection of our, your, or others’ rights, safety, and property.
- Internal compliance audits.
- Enforcement of Service terms and conditions.
- Fraud prevention, detection, and investigation, including cyberattacks and identity theft.
C. Creation of Non-Identifiable Information
We may create de-identified data records by removing personally identifiable information. This anonymized data is used for analyzing usage patterns to enhance our products and services and may be disclosed to third parties at our discretion.

This Privacy Policy is specific to the App and doesn’t override other privacy notices.
B. Third-Party Service Providers
We share personal information with service providers for app-related services, including service delivery, quality assurance, account creation, technical support, and performance optimization.

We may disclose your personal information to law enforcement, government authorities, and private parties for compliance and protection purposes.
Links to Other Sites
The App may contain links to third-party websites. Clicking these links will take you outside the App, and external sites may collect your information. County National Bank is not responsible for the content or privacy practices of these external sites. We recommend reviewing the privacy policies of every website you visit.
Your Choices Regarding Your Information
A. Do Not Track Signals
We currently do not respond to “do not track” signals from web browsers.
B. Access, Update, or Correct Your Information
You can access and update your information within the App settings. For additional requests, contact us.
C. Opting Out of Email or SMS Communications
Unsubscribe from marketing emails via the “unsubscribe” link in emails or contact us. Opt-out of SMS notifications by unlinking your mobile number in the Services.
D. Opting Out of Location Tracking
Disable location tracking at any time through your mobile device settings. Note that disabling location tracking may limit some App features.
Safeguards and Retention
We implement security measures to protect your information against unauthorized access, use, or disclosure. However, internet transmissions are not fully secure, and we cannot guarantee absolute security.
Children’s Privacy
The Services are not intended for individuals under 18, and we do not knowingly collect personal information from children under 18 through the App. If we learn that we have collected personal information from a child under 18, we will take steps to delete it as soon as possible.
Privacy Policy Updates
This Privacy Policy may be revised periodically. Material changes will be communicated by posting a notice within the Services. Changes are effective 30 days after notice for existing users and immediately for new users. Continued use of Services after changes indicates acceptance.

Alerts Additional Terms
These terms apply specifically to the Alerts feature within County National Bank Mobile Banking.
Alerts Service
Enrollment in County National Bank Online and/or Mobile Banking includes automatic enrollment for transaction alerts and notifications (“Alerts”). Alerts provide transactional information about your County National Bank accounts in categories such as:
- Mandatory Alerts: Essential account notifications (password changes, login information updates). These alerts cannot be suppressed.
- Account Alerts: Notifications about important account activities or changes. Activated automatically, suppression is discouraged due to important account information.
- Additional Alerts: User-activated alerts, accessible via the “More” menu in Mobile Banking.
Account Alerts and Additional Alerts are managed online through the Service, not entirely via mobile devices. County National Bank may add, modify, or cancel Alerts over time, typically with notification, but without obligation. County National Bank reserves the right to terminate the Alerts service at any time without notice.
Methods of Alert Delivery
Alerts may be delivered through: (a) SMS text message, (b) push notification, (c) email, or (d) County National Bank Online Banking message in-box. You agree to receive Alerts through these channels and are responsible for ensuring your service providers support these alert types. Standard text/data rates may apply. Alert frequency varies. Provide a valid mobile number or email for Alerts and update us of any changes.
Text Message Alerts
To stop SMS Alerts, text “STOP” to 99588. This does not affect email alerts. To reinstate SMS Alerts, re-enable them in County National Bank Online Banking. For SMS help, text “HELP” to 99588. For questions, contact customer service at 888-322-1088. Participating carriers are listed above.
Limitations of Alerts
County National Bank Alerts are a convenience service for informational purposes only and are not official bank records. While we aim for timely and accurate Alerts, delivery may be delayed or prevented by factors outside our control, including mobile service provider issues or internet outages. County National Bank does not guarantee delivery or accuracy. We are not liable for losses or damages arising from non-delivery, delays, misdirected delivery, inaccurate content, or reliance on Alert information.
Alert Information Security
Alerts via SMS, email, and push notifications are not encrypted. They will not include full account numbers or passcodes, but may include your name and some account details. Anyone with access to your Alerts can view message contents.
Privacy and User Information – Data Analytics
County National Bank and its service providers may collect data about your Mobile Banking usage (session length, transactions, geolocation) and other data to improve services, perform analytics, and as legally permitted. Data is protected with reasonable safeguards but may be used and disclosed for service delivery, legal compliance, security, claim defense, and as authorized by you.
Biometric Login for Mobile Banking
County National Bank Mobile Banking offers optional biometric login (fingerprint or facial recognition) on compatible Apple® (Touch ID™ or Face ID™) and Android® devices. Biometric login requires biometric setup on your device (contact device manufacturer for assistance). Biometric data is stored only on your device; County National Bank does not access or store this information. Enabling biometric login allows anyone with stored biometrics on your device to access your Mobile Banking account. County National Bank reserves the right to disable this feature. Biometric login is linked to one Mobile Banking username per device. Standard login credentials (password) can be used if biometric recognition fails. Biometric login must be set up separately for each device and can be enabled/disabled within Mobile Banking settings.

A. Access to Mobile Banking
Mobile Banking requires a compatible Mobile Device with 256-bit encryption and internet access through a mobile provider. Mobile Banking Software download and installation are necessary. Downloading and using Mobile Banking Software requires agreement to additional terms and conditions with our provider and licensor. County National Bank is not liable for Mobile Device damage from software download or use. Software download instructions are on our website’s Mobile Banking section. Some devices may require SMS capability to initiate download. Authorized Users are responsible for deleting Mobile Banking Software from devices when access is no longer desired or authorized.
Mobile Banking is available only to Online Banking users, using the same Username and password.
Mobile Banking offers a menu of functions (balance view, transaction search, transfers, branch locations, etc.). County National Bank may modify Mobile Banking functions or service areas without prior notice, unless legally prohibited.
County National Bank does not guarantee Mobile Banking availability on all devices, networks, regions, or at all times. We are not liable for damages from Mobile Banking access issues, function unavailability, transaction failures, or information access problems.
If an Authorized User changes Mobile Devices, software must be re-downloaded and installed under this Agreement’s terms. Authorized Users must delete all Mobile Banking Software upon Agreement or license termination. County National Bank reserves the right to change third-party software providers, substitute software, and arrange software provision through other licensors.
B. Types of Mobile Banking Transactions
Authorized Users can use Mobile Banking to:
- Review account balances and transaction histories.
- Transfer funds between Accounts (excluding certificates of deposit).
- Set up and receive mobile account alerts.
- Track expenses from Accounts.
- Initiate Bill Pay transfers.
- Add new payees.
- Deposit checks.
Transactions are subject to deposit account or line of credit agreement terms and disclosures.
C. Posting of Mobile Transfers
Mobile transfers (excluding Bill Pay) before 7:00 p.m. ET on a Business Day are posted the same day. Transfers after 7:00 p.m. ET or on non-Business Days are posted the next Business Day. Authorized Users should coordinate to prevent overdrafts or exceeding credit limits. See Section IV.C for Bill Pay transfer processing.
D. Mobile Transaction Limits
Savings or money market account transfers to other accounts or third parties via preauthorized, automatic, or telephone transfers are limited to six per month/cycle. Certificate of deposit transfers are not allowed via Mobile Banking. Bill Pay initiation via Mobile Banking is limited to checking accounts.
E. Mobile Alerts Management
Mobile Banking provides automatic, account-related alerts. Users can customize, deactivate, or reactivate alerts within Mobile Banking. County National Bank may add or remove alert types at its discretion. Alerts are sent via Mobile Banking to the notification system, phone number, or primary email provided for Mobile Banking. Users are responsible for updating contact information changes.
Alert delivery may be delayed or prevented for various reasons. County National Bank attempts timely and accurate alerts but does not guarantee delivery or content accuracy. We are not liable for delays, non-delivery, misdirection, errors in content, or actions taken based on alerts.
F. Export Controls for Mobile Banking Software
Mobile Banking Software and related materials may be subject to U.S. export controls. Users agree to comply with all export regulations and not attempt to export or re-export software to restricted entities or embargoed countries.
G. Mobile Banking Fees
Currently, County National Bank does not charge direct fees for Mobile Banking. However, standard account fees (e.g., overdraft fees) may apply, even if incurred through Mobile Banking. Bill Pay fees are in Section IV.E. County National Bank reserves the right to add or change Mobile Banking fees with notice, as per this Agreement and law. You authorize fee deductions from your Accounts.
Users are responsible for mobile service provider fees, internet usage charges, and SMS text message fees.
H. Mobile Stop Payment Requests
To stop recurring Electronic Funds Transfers from a deposit account set up via Mobile Banking, call 1-888-322-1088 or write to County National Bank, One South Howell Street, P.O. Box 283, Hillsdale, Michigan 49242. Stop payment requests must be received at least three (3) Business Days before the scheduled transfer. County National Bank is liable for losses if a timely stop payment request is not honored.
IV. Mobile Deposit Terms and Conditions
A. Mobile Deposit Services
County National Bank’s mobile deposit capture services (“Services”) allow you to deposit checks into your checking or savings accounts by scanning checks and transmitting images and deposit information to County National Bank or its processor. Designated accounts (“Authorized Accounts”) must be set up through County National Bank online banking. Each deposit is a “Mobile Deposit Transaction.” Mobile Deposit uses your smartphone camera to capture check images and submit them electronically. Visual guides assist with check centering. Image quality is checked upon submission, with immediate notification for recapture if needed. Transactions can be cancelled before submission but not after. By using Mobile Deposit, you authorize County National Bank to convert checks to images or substitute checks for clearing. County National Bank reserves the right to modify the Service at any time, with continued use indicating acceptance of changes.
B. Acceptance of Mobile Deposit Terms
Electronically accepting this Agreement signifies agreement to all terms. This Agreement is subject to change with notification of material changes and advance notice as legally required. Continued Service use after notice implies acceptance of revisions.
C. Limitations of Mobile Deposit Service
Mobile Deposit may experience technical issues. County National Bank is not responsible for technical difficulties or resulting damages. We reserve the right to change, suspend, or discontinue Services at any time without notice.
D. Mobile Deposit Hardware and Software
Using Mobile Deposit requires compatible hardware and software as specified by County National Bank (see CNBB.BANK for current specifications). You must download and install the Service application from your wireless provider. County National Bank is not responsible for third-party software, which is accepted “as is” and subject to third-party terms. You are responsible for internet, cellular, and data charges from your providers.
E. Mobile Deposit Fees
Fees may apply for Mobile Deposit Services. You are responsible for paying these fees, which County National Bank may change as per the “Acceptance of these Terms” section. You authorize County National Bank to deduct fees from any of your accounts.
F. Eligible Items for Mobile Deposit
Only “checks” as defined by Federal Reserve Regulation CC (“Reg. CC”) should be scanned and deposited. Transmitted check images converted to Image Replacement Documents are considered “items” under Uniform Commercial Code Articles 3 and 4.
G. Ineligible Items for Mobile Deposit
The following items are ineligible for Mobile Deposit:
- Third-party checks (payable to someone else).
- Checks with alterations or suspected fraud.
- Substitute checks.
- Checks drawn on foreign banks or institutions outside the U.S.
- Remotely created checks.
- Checks not in U.S. currency.
- Checks dated over 6 months prior to deposit.
- Non-negotiable checks.
- Redeposited or returned checks.
- Incomplete checks.
- Checks prohibited by County National Bank procedures or Account Agreements.
- Checks with mismatched numerical and written amounts.
- Checks payable to “cash.”
- Money orders.
- Savings bonds.
- Counter checks.
Depositing ineligible items may result in immediate Service termination and transaction reversal, potentially leading to negative balances and overdraft fees, which are your responsibility.
H. Mobile Check Endorsements
Endorse checks on the back within 1 ½ inches from the top edge, indicating “For Mobile Deposit Only CNB.” Irregular endorsements or markings are your responsibility for any resulting losses or processing errors. Checks payable to two payees must be deposited into an account with matching ownership. Mismatched payees and account ownership will result in check return.
I. Receipt of Mobile Check Images
County National Bank reserves the right to reject any check image. We are not liable for images not received or corrupted during transmission. A check image is considered received upon “accepted status” confirmation from the Service. Confirmation does not guarantee error-free transmission, deposit completion, or prevent chargebacks if the check is dishonored.
J. Funds Availability for Mobile Deposits
Mobile Deposits are classified as “not-in-person deposits” under Regulation CC and follow County National Bank’s Funds Availability Policy. Deposits made before 6:00 pm on a Business Day are credited that day; deposits after 6:00 pm or on non-Business Days are credited the next Business Day. Funds from mobile deposited checks are typically available the next Business Day, but delays may occur. Credit is provisional until settlement is final. Refer to County National Bank’s Funds Availability Policy for detailed information.
K. Retention and Disposal of Mobile Deposited Items
Upon confirmation of image receipt, mark the physical check as “Electronically Presented” or “RDC and date” to prevent redeposit. Store original checks securely for 60 days post-transmission, then destroy them safely no later than 90 days after transmission. You are responsible for losses due to failure to secure original checks and agree never to redeposit checks. Provide original or sufficient copies of checks to County National Bank upon request for clearing, claims resolution, or audits. Inability to provide copies may result in liability for unresolved claims.
L. Mobile Deposit Limits
County National Bank may set limits on deposit amounts and item numbers, rejecting deposits exceeding these limits. Permitted exceptions do not obligate County National Bank to allow future exceptions. We are not liable for losses from rejected deposits exceeding limits. Current Mobile Deposit limits are $2,500 per day or 25 checks.
M. Mobile Deposit Errors
Notify County National Bank immediately of suspected errors for Mobile Deposits, no later than 30 days after the account statement is sent. Statements are deemed correct after 60 days, barring claims against County National Bank for errors reported after this period.
N. Errors in Mobile Transmission
Using Mobile Deposit implies accepting the risk of item interception or misdirection during transmission. County National Bank is not liable for intercepted or misdirected items or information disclosed due to transmission errors.
O. User Warranties and Indemnification for Mobile Deposit
You warrant and represent that:
- Each transmitted check image is an accurate representation of the original check, unaltered, not fraudulent, and the drawer has no payment defense.
- Check details (amount, payee, signatures, endorsements) are legible, genuine, and accurate.
- Checks submitted for deposit will not be resubmitted in any form, preventing double debits.
- No duplicate images exist besides the deposited digital image.
- Each original check was authorized by the drawer for the stated amount and payee.
- All material information has been communicated to County National Bank.
- Original checks are retained for the required period and will not be resubmitted for payment.
- Accounts used for Mobile Deposit are for consumer, not business, purposes.
- Services and accounts will not be used for illegal activities.
- Transmitted files and images are virus-free and will not harm County National Bank systems.
You agree to indemnify and hold County National Bank harmless from all claims, actions, damages, liabilities, costs, and expenses, including attorney fees, arising from your use of Mobile Deposit or breach of this Agreement. This indemnification clause survives Agreement termination.
P. Mobile Deposit Termination
You can terminate Mobile Deposit Services via written request to [email protected]. County National Bank may terminate your Service use at any time. Termination does not relieve liability for prior transactions.
Q. Ownership & License of Mobile Deposit Service
County National Bank retains all ownership and proprietary rights to Mobile Deposit Services, technology, content, and websites. Service use is conditioned on Agreement compliance. Breach of Agreement immediately terminates Service rights. Services are for non-business, personal use only. You may not copy, reproduce, distribute, or reverse engineer Mobile Deposit technology.
R. Mobile Deposit Returns
Credits for Mobile Deposit Transactions are provisional. Returned checks or chargebacks will be deducted from your account, along with associated fees as per fee schedules and Account Agreements. County National Bank is not liable for losses from returned deposits.
S. Mobile Deposit Security
Complete each deposit promptly and keep your mobile device secure until deposit completion. Maintain procedures against unauthorized deposits. Immediately notify County National Bank of lost or stolen original checks. Ensure original check safety until destruction. County National Bank reserves the right to monitor Mobile Deposit activity and requires your cooperation in such monitoring to verify Agreement compliance.
V. Account to Account Transfer Terms of Service
GENERAL TERMS FOR EACH SERVICE
1. Introduction
This Terms of Service document (“Agreement”) is a contract between you and County National Bank (“we” or “us”) for each service described herein (“Service”) offered through our online banking site or mobile applications (“Site”). The Agreement includes these General Terms and specific Terms applicable to each Service you use. This Agreement governs your Service use and the Service-related Site portion.
2. Service Providers
County National Bank offers Services through Service Providers, but we remain solely liable for Service-related payments and transfers and responsible to you and third parties for any Service-related liability. We may delegate rights and obligations to Service Providers, who are third-party beneficiaries of this Agreement.
3. Amendments to the Agreement
We may amend this Agreement and fees by posting revisions on the Site, effective immediately unless stated otherwise. Service use after changes implies agreement. We may revise, update, or enhance Services, rendering prior versions obsolete and reserve the right to terminate this Agreement for prior versions and limit access to current versions.
4. Our Relationship With You
We are an independent contractor, acting as your agent for fund custody. We are not responsible for products/services paid for using our Service or guarantee user identities.
5. Assignment of Rights
You cannot transfer or assign your Agreement rights without our written consent. We may transfer or assign this Agreement or delegate rights/responsibilities to third parties at any time.
6. Notices to County National Bank Regarding the Service
Except as noted, send notices by mail to: One South Howell Street Hillsdale MI 49242. For questions, call 888-322-1088. Phone calls are not legal notices except for error reporting as per Section 22.
7. Notices to You
We may provide notices via Site posting, in-product messages, email, postal mail, or text message. Notices are deemed received within 24 hours of sending/posting, or 3 Business Days for postal mail. You can request paper copies of legally required disclosures for a fee up to $20. Withdrawing electronic communication consent may result in Service termination.
8. Text Messages, Calls and/or Emails to You
Providing a phone number/email implies consent to receive calls/emails from us and Service Providers, including autodialed calls, for business purposes (identity verification, etc.). Review our Privacy Policy for more information.
9. Receipts and Transaction History
View transaction history online instead of mailed receipts.
10. Your Privacy
Review our Privacy Policy to understand our privacy commitment and information use.
11. Privacy of Others
Keep confidential any information received about others through the Service and use it only for Service-related purposes.
12. Eligibility for Service
Service is offered to U.S. residents capable of legally binding contracts, not minors unless using a minor’s account with a parent/guardian co-signor. By using the Service, you confirm you meet eligibility requirements and agree to this Agreement.
13. Prohibited Payments via Service
Prohibited payments include:
- Payments to/from prohibited territories (outside the U.S.).
- Payments violating laws, regulations.
- Payments violating Acceptable Use terms (Section 14).
- Payments related to regulated products (tobacco, prescription drugs, etc.), illegal goods, sexually oriented content, hate/violence promotion, gambling, pyramid schemes, real estate/investment purchases, money laundering, or money service businesses.
- Tax payments and court-ordered payments.
We are not liable for claims from prohibited payments. Report violations per Section 6.
14. Acceptable Use of Service
Comply with all laws in Service use and communications. We may monitor and remove objectionable content. Prohibited uses include:
- Violating laws, promoting hate/violence, defamation, offensive content, infringement of rights.
- Overloading infrastructure, facilitating viruses, using robots to copy Service content without permission, bypassing security, or interfering with Service operation.
- Actions that could cause loss of services from our vendors.
Report violations per Section 6.
15. Payment Methods and Amounts
Transaction limits apply and may change. View individual limits online. We or our Service Provider choose fund remittance methods and methods for returning funds if your account is closed. Methods may include electronic debit, paper check, or draft check.
16. Your Liability for Unauthorized Transfers
Report unauthorized Payment Instructions immediately to customer care as per Section 6. Time is critical. If reported within 2 Business Days of discovery of lost/stolen access credentials, liability is capped at $50. If reported after 2 Business Days, liability may increase to $500. Report unauthorized transactions on your monthly statement within 60 days to avoid potential losses. Time extensions may be granted for valid reasons (travel, hospitalization).
17. Taxes
You are responsible for determining, collecting, reporting, and remitting applicable taxes for transactions. We are not responsible for tax matters.
18. Failed or Returned Payment Instructions
If a Payment Instruction fails due to insufficient funds or credit limits, it may not be completed. In some cases, Service Providers may advance funds and re-attempt debiting your account. You agree to:
- Reimburse Service Providers immediately for delivered payments with insufficient funds.
- Pay a late fee of 1.5% of unpaid amounts plus collection costs if funds are insufficient, in addition to NSF fees from County National Bank. You authorize fee deductions from your account.
- Service Providers may report returned payments to credit agencies.
19. Address or Banking Changes
Maintain accurate user profile information, including contact details and account information. Changes may be made online or via customer care (Section 6). We are not liable for errors or fees from inaccurate information.
20. Information Authorization
Enrollment may be denied if identity or necessary information cannot be verified. You authorize credit rating reviews and obtaining personal information, including financial details. We may use your information for Service operation, fraud prevention, compliance, security, dispute resolution, and Service improvement, as per our Privacy Policy. We and Service Providers may retain data post-termination for risk management and compliance.
- Mobile Subscriber Information: Authorize wireless carrier disclosure of account details for identity verification and fraud prevention.
- Device Data: We may share device data with third-party providers for fraud management, including blocking fraudulent devices, without sharing personally identifying information.
21. Service Termination, Cancellation, or Suspension
Cancel Service via Section 6 contact methods. Payments in process before cancellation will be completed. We may terminate or suspend Service access for any reason. Termination does not affect your liabilities.
22. Errors, Questions, and Complaints
a. Contact us for transaction errors/questions as per Section 6.
b. Report statement errors within 60 days of statement date:
- Provide your name.
- Describe the error/transaction and reasons for believing it is an error or needing more information.
- State the dollar amount of the error.
c. Written confirmation of oral complaints may be required within 10 Business Days. We will investigate within 10 Business Days (up to 45 days if more time is needed). Provisional credit may be applied within 10 Business Days. Written explanation will be provided if no error is found. Document copies used in investigation are available upon request. Provisional credit may be revoked if no error is found.
23. Intellectual Property Rights
Service marks, logos, and Site content are owned by us or our licensors. You cannot copy, imitate, or use our trademarks without written consent or in a disparaging manner. Service technology and content are our exclusive property. Suggestions or feedback become our uncompensated intellectual property. By submitting materials, you grant us a perpetual, royalty-free license to use, modify, and distribute them.
24. Links and Frames to Third Party Sites
Links to third-party sites are provided for convenience, not endorsement. We are not responsible for linked site content, accuracy, or practices. Links may lead you off our Site. You may link to our homepage but not other pages without permission and may not frame our Site content. We reserve the right to disable third-party links.
25. Password and Security
Protect your passwords and access credentials. Notify us immediately at 888-322-1088 if credentials are lost, stolen, or misused. See Section 16 for liability related to unauthorized transfers.
26. Remedies for Breach of Agreement
If you breach this Agreement, we may terminate/suspend Service access, notify authorities, refuse future service, and/or take legal action. We may terminate this Agreement at any time for any reason. Remedies are cumulative.
27. Disputes Resolution
Disputes will be resolved according to this Agreement.
28. Arbitration Clause
For claims under $10,000, arbitration may be elected via JAMS, AAA, or mutually agreed ADR. Arbitration is binding, non-appearance-based, without discovery, and must be decided within 90-120 days. Awards are final and enforceable in court. Class actions are prohibited in arbitration.
29. Governing Law and Forum for Disputes
This Agreement is governed by the laws of your state of residence. Disputes must be resolved in courts in your county of residence, unless arbitrated. Jury trial waiver applies to all disputes.
30. Indemnification
You agree to indemnify and hold us, Affiliates, Service Providers, and their employees harmless from losses arising from your breach of this Agreement or Service use.
31. Release from Claims
You release us, Affiliates, Service Providers, and their employees from claims related to disputes with other Service users. California Civil Code §1542 waiver applies.
32. No Waiver of Rights
Our failure to enforce rights does not constitute a waiver unless in writing.
33. Exclusions of Warranties
SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR SECURE ACCESS. Some states do not allow disclaimer of implied warranties.
34. Limitation of Liability
YOUR EXCLUSIVE REMEDIES AND OUR TOTAL LIABILITY ARE LIMITED AS STATED HEREIN. WE ARE NOT LIABLE FOR SERVICE DELAYS OR DISRUPTIONS BEYOND OUR CONTROL. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. CLAIMS MUST BE FILED WITHIN TWO YEARS OF THE EVENT. OUR AGGREGATE LIABILITY IS CAPPED AT $500. Some states do not allow limitation of incidental or consequential damages.
35. Complete Agreement, Severability, Captions, and Survival
This Agreement is the complete agreement, superseding prior agreements. Invalid provisions will be struck, remaining provisions enforced. Section captions are for convenience. Sections 2, 5-7, 11, 17, 18, 23, and 26-35, and other terms that should survive, will survive termination. Agreement terms prevail over employee/contractor statements.
36. Definitions
- “ACH Network”: Funds transfer system governed by NACHA Rules.
- “Affiliates”: Related companies under common control.
- “Business Day”: Monday-Friday, excluding Federal Reserve holidays.
- “Eligible Transaction Account”: Account for debits/credits, including checking, money market, credit card, or debit card accounts.
- “Payment Instruction”: Information for payment processing.
- “Payment Network”: Debit/credit networks like ACH or ACCEL/Exchange.
- “Service Provider”: Companies engaged to provide Service components.
ACCOUNT TO ACCOUNT TRANSFERS ADDITIONAL TERMS
1. Description of Service, Authorization and Processing.
a. “Transfer Money Terms” refer to these additional terms for the Account to Account transfer service (“Service”). Service enables transfers between your County National Bank accounts and accounts at other financial institutions (“External Accounts”).
b. You warrant ownership of Eligible Transaction Accounts and External Accounts and have authority to transfer funds. Joint account owners warrant authorization from all owners. External Accounts must be in the U.S.
c. Transfer Instructions can be one-time (immediate or scheduled) or recurring. By initiating a transfer, you authorize County National Bank to debit/credit your Eligible Transaction Account and remit funds to/from your External Account and debit fees. You also authorize reversal of transfers if debits are returned. Transfers may be delayed/blocked for fraud prevention or compliance.
d. County National Bank is not liable for transfer failures due to:
- Insufficient funds in Accounts.
- Service malfunction (known or advised).
- Transfer refusal (Section 6).
- Incorrect information provided by you.
- Circumstances beyond our control (system downtime, etc.).
e. You are responsible for information accuracy and notifying us of inaccuracies. We will attempt to recover funds sent to the wrong account but do not guarantee recovery and are not liable for damages from incorrect information.
2. Transfer Methods and Amounts
General Terms Section 15 (Payment Methods and Amounts) applies, even for closed External Accounts for fund returns.
3. Transfer Cancellation Requests
Cancel transfers until processing begins (as shown in Service).
4. Stop Payment Requests
For processed transfer stop payments, contact customer care (General Terms Section 22). We will attempt to accommodate requests but are not liable for failures. Written requests within 14 days may be required with applicable stop payment fees.
5. Service Fees and Additional Charges
You are responsible for Service fees, disclosed in the Service interface. Fees apply regardless of Service usage, except use-based fees. Use-based fees are charged to the account debited for transfer. Additional transaction and optional service fees may apply. You authorize fee deductions from your Eligible Transaction Account or the account debited for transfer. Standard account fees still apply. You are responsible for phone and internet access fees. General Terms Section 18 (Failed Payments) applies if fees are unpaid, including if External Accounts have insufficient funds.
6. Refused Transfers
We reserve the right to refuse transfers and will notify you as legally required.
7. Returned or Failed Transfers
Transfers may fail for reasons like invalid External Account numbers. We will attempt to correct or void failed transfers. We will attempt to return unclaimed, refused, or failed transfers to your debited Account as legally permitted. You may need to contact us or your External Account institution to receive returned funds. Notifications may be sent.
8. Definitions
- “Account”: Checking, money market, or savings account, either Eligible Transaction Account or External Account.
- “Eligible Transaction Account”: Your checking, money market, or savings account with County National Bank.
- “External Account”: Your account at another financial institution involved in transfers.
- “Transfer Instruction”: Specific Payment Instruction for fund transfer.
VI. Bill Pay Terms and Conditions
A. Access to Bill Pay Service
Authorized Users can initiate Bill Pay and Person to Person transfers via Online or Mobile Banking. Bill Pay transfers are limited to designated payees. Payee setup requires Online Banking login to enter payee information. Update payee information immediately upon changes. Notify us if payees do not receive payments.
We are not responsible for failed transfers due to incorrect payee information or subsequent failures to the same payee. Payees must be in the U.S. County National Bank reserves the right to prohibit or remove payees. Remove payees when transfers are no longer needed.
Bill Pay may be occasionally unavailable. We will attempt to post notifications of extended downtimes, but availability is not guaranteed. We are not liable for damages due to Bill Pay access or transaction execution issues.
B. Types of Bill Pay Transactions
Bill Pay is for payments from checking accounts only, for one-time or recurring transfers to designated payees. No transfer limit on number, but individual transfers cannot exceed $25,000.
C. Processing Bill Pay Transfers
One-time transfer requests must be received by 3:00 p.m. ET on the Business Day for processing. Requests after 3:00 p.m. ET or on non-Business Days are processed the next Business Day.
Recurring transfer series setup requests must be received by 3:00 p.m. ET on the Business Day for the first transfer processing. Subsequent recurring transfers are processed based on selected frequency, adjusted for non-Business Days based on “Before Option” (processed prior Business Day) or “After Option” (processed next Business Day).
Transfers scheduled for the 29th, 30th, or 31st of the month in shorter months are processed on the last day of that month. Estimated Arrival Dates are estimates only; timely payee payment is your responsibility.
We may process transfers via various methods, including mailing bank checks to payees.
D. Canceling or Stopping Bill Pay Transfers
One-time transfers can be changed or cancelled in Bill Pay before 3:00 p.m. ET on the processing date. Individual transfers within a recurring series can also be changed/cancelled before this deadline. Recurring series can be modified in Bill Pay.
To stop recurring Electronic Funds Transfers set up through Bill Pay, Online Banking, or Mobile Banking, call 1-888-322-1088 or write to County National Bank, One South Howell Street, P.O. Box 283, Hillsdale, Michigan 49242. Stop payment requests must be received at least three (3) Business Days before the scheduled transfer. County National Bank is liable for losses if timely stop payment requests are not honored.
E. Bill Pay Fees and Charges
Bill Pay service fees include:
- Overnight Fee: $19.95 (expedited overnight mail delivery)
- Second Day Delivery Fee: $14.95 (expedited second-day mail delivery)
- Second Day Electronic Delivery: $4.95 (expedited second-day electronic delivery)
- Charitable Donation Fee: $1.99
- Gift Pay Fee: $2.99
Standard account fees (e.g., overdraft fees) may also apply due to Bill Pay use. You authorize fee deductions from your deposit Accounts. County National Bank reserves the right to add or change fees with notice, as per this Agreement and law.
You are responsible for internet and mobile service provider fees and all third-party charges from Bill Pay use.
F. Person to Person Transfers
You warrant ownership and full rights to funds in accounts used for transfers. You authorize County National Bank to execute requested transfers. Processing may be delayed, and County National Bank is not liable for delays or failures beyond our control.
You can transfer funds from your Accounts to a Recipient’s account using a mobile number, email, or routing/account number.
G. Frequency of Person to Person Transfers
No limit on transfer frequency, but account rules apply. County National Bank may modify transfer limits and frequency for security reasons.
H. Dollar Amount Limits for Person to Person Transfers
Transfer amounts are subject to limits in the Service. County National Bank reserves the right to change these limits. Suspended and reinstated Service may have lower initial limits.
J. Rejection of Person to Person Transfers
County National Bank reserves the right to decline any transfer or related requests.
K. Authorization for Person to Person Transfers
You authorize County National Bank to select transfer methods. We utilize ACH, debiting your Account and crediting another account or Recipient’s account. Funds are transferred via our service provider’s account. If debits fail but credits are released, you authorize our service provider to collect from the credited account. We may resubmit debits. You authorize debits from credited or debited accounts for collection. Fees may apply.
If debits fail and credits cannot be collected, we may debit any of your other Accounts to cover deficiencies, without prior notice.
For transfers to Recipients, provide accurate email addresses. We will contact Recipients for account details. If Recipients fail to respond, funds will be returned to your Account.
L. Suspension and Reinstatement of Person to Person Transfer Service
County National Bank may suspend Service access if issues arise, including debit failures, without notice, to protect from losses. Reinstatement requests can be made via contact methods in this Agreement. Reinstatement is at County National Bank’s discretion and may include lower transaction limits initially. Limits may be increased based on subsequent usage.
M. Your Responsibility for Person to Person Transfer Errors
You authorize County National Bank to act on instructions that appear to be from you. You are responsible for providing correct information. We will attempt to reverse incorrect instructions but are not liable for losses from your errors or fraud. You agree not to impersonate others or use unauthorized names. Inaccurate information may result in cost recovery from you.
N. Credit Screening for Person to Person Transfers
County National Bank may perform soft credit inquiries for risk assessment and setting Service limits, without affecting your credit score.
VII. General Terms for Online Banking, Mobile Banking and Bill Pay
A. Limitation on Use
Online Banking, Mobile Banking, and Bill Pay must not be used for illegal transactions, activities, or in violation of any laws, regulations, or ordinances, including internet gambling.
B. Confidentiality of Account Information
We may disclose Account and transaction information:
- To complete transactions.
- When legally required.
- To prevent illegal activity.
- To prevent fraud or unauthorized transactions.
- To fiduciaries or representatives of account owners.
- To our attorneys, auditors, or examiners.
- With your permission or another account owner’s permission.
C. Account Statements and Other Notices
Monthly statements for checking accounts, quarterly for savings, and periodic statements for lines of credit. No regular statements for certificates of deposit.
Notices under this Agreement will be sent to your last known email address, via Online Banking, or by mail, effective upon sending unless specified otherwise. Notify us immediately of address changes. Your notices to us must be written, effective upon receipt, and mailed to County National Bank, One South Howell Street, P. O. Box 283, Hillsdale, Michigan 49242.
D. Overdrafts (Order of Payments, Transfers, and other Withdrawals)
If deposit accounts have insufficient funds, currency disbursements (POS, ATM withdrawals) have priority. Online/Mobile Banking transfers (including Bill Pay) may be cancelled to prevent overdrafts. Overdraft fees may apply if transfers are not cancelled.
E. Mobile Device, Internet and Mobile Communications Providers
County National Bank is not responsible for your agreements with mobile or internet providers, or for Mobile Devices, hardware, or software. This Agreement does not override third-party agreements, and you are subject to their terms and fees. Resolve issues with providers directly.
Mobile Devices and computers may be vulnerable to malware. County National Bank is not responsible for advising on malware risks. Use of devices is at your own risk. Notify us immediately if devices are compromised or lost/stolen.
F. Lost or Stolen Username or Password

G. In Case of Errors or Questions about Your Electronic Funds Transfers
Contact us at 1-888-322-1088 or County National Bank, P.O. Box 283, Hillsdale, Michigan 49242 ASAP if you believe your statement is wrong or need transaction information, no later than 60 days after the statement date.
Provide your name, account number, error description, and dollar amount. Written confirmation may be required within 10 Business Days. We will investigate within 10-45 Business Days and provisionally credit your account for errors. Written explanation will be provided if no error is found.
H. Disclaimer of Warranties
Use of Online Banking, Mobile Banking, and Bill Pay is at your own risk. County National Bank is not responsible for device or data damage. Services are provided “AS IS” without warranties of reliability, timeliness, quality, suitability, availability, accuracy, or error-free operation. All other warranties are disclaimed to the maximum extent permitted by law.
I. Our Liability for Failure to Process An Electronic Funds Transfer
County National Bank is liable for losses if Electronic Funds Transfers are not processed correctly, except in cases of:
- Insufficient funds.
- Legal restrictions on funds.
- Overdraft limit issues.
- User equipment malfunction.
- County National Bank system malfunction (known or advised).
- Payee or payee’s institution mishandling.
- Incorrect or insufficient user information.
- Circumstances beyond our control (disasters, conflicts).
- Failure to notify us of non-receipt of recurring transfers.
J. Your Limited Liability for Unauthorized Transfers
Report lost/stolen credentials or unauthorized transfers IMMEDIATELY. Liability is limited to $50 if reported within 2 Business Days of discovery. Liability may increase to $500 if reported later. Report unauthorized statement transfers within 60 days to minimize losses. Time extensions may be granted for valid reasons.
K. Limitation of Liability and Indemnification
To the extent permitted by law, you agree to indemnify County National Bank against claims arising from your use of Online Banking, Mobile Banking, or Bill Pay or breach of this Agreement. County National Bank is not liable for direct, indirect, incidental, special, consequential, or exemplary damages, including loss of profits or data, regardless of claim type, except as legally required. We are not liable for failures due to legal restraints, transmission issues, emergencies, or circumstances beyond our control. Claims must be initiated within one year of knowledge of the claim.
L. Copyright, Trademark and Ownership
Mobile, online, and bill pay technologies are owned by County National Bank or third parties. Unauthorized copying, distribution, or commercial use of content is prohibited. Trademarks and logos are owned by County National Bank or others.
M. Amending this Agreement
County National Bank may amend this Agreement with notice. Continued use after notice implies acceptance of amendments.
N. Termination and Suspension
Either party may terminate this Agreement with 10 days’ written notice. You remain responsible for transfers processed before termination. County National Bank may terminate immediately for breach of Agreement or law violations. Automatic termination occurs upon account closure, withdrawal of electronic notice consent, license termination, or service discontinuation. Upon termination, service access ceases, but prior obligations remain.
County National Bank may suspend Service use without termination for insufficient funds, inactivity, login failures, or suspected fraud. To reinstate suspended service, contact us at 517-439-4300 or 888-322-1088 or [email protected].
O. Governing Law
This Agreement is governed by Michigan law.
P. Severability
Invalid provisions will be interpreted to fulfill their purpose to the extent permitted by law, with remaining provisions in effect.
Q. Entire Agreement
This Agreement and account agreements constitute the entire agreement, superseding prior agreements. In case of inconsistencies, this Agreement prevails.
R. No Waiver
No waiver of any condition or obligation is a waiver of any other condition or obligation.
S. Jury Waiver
YOU AND COUNTY NATIONAL BANK VOLUNTARILY WAIVE JURY TRIAL RIGHTS IN ANY LITIGATION RELATED TO ONLINE BANKING, MOBILE BANKING, BILL PAY, OR THIS AGREEMENT.
